Podcast with John Eidsmoe on Trial by Jury and Recent Clancy Case Controversy
Topic: Trial by Jury…No More?
The practice of trial by jury is a time-honored tradition in Western law, including the United States. Trial by jury is mentioned in the Declaration of Independence and the U.S. Constitution. Recently, out of Plymouth, Massachusetts (of all places), there was the famous trial of Lindsay Clancey, who was being tried for murdering her three children. The trial ended in mistrial because of one lone holdout juror. And many, including Lindsay’s attorney, was trying to punish and target that juror. Is that good for our legal system? “Do your civic duty. Serve on a jury—oh, and if you stick to your conscience and we don’t like your vote, we may and try and crucify you.” Law professor John Eidsmoe, author of the book, Christianity and the Constitution, joins Jerry Newcombe to discuss the notion of trial by jury, being under fire. www.morallaw.org
